Booyah for Buggery
I wasn’t sure how I felt about Lawrence and Garner v. Texas – you know, the sodomy case – until I heard the decision. On the one hand, laws against sodomy are abominable intrusions of government into personal matters. On the other hand, I believe in federalism, and it wasn’t obvious to me that the Constitution should be construed to prohibit this particular kind of regulation at the state level.
So I thought I was ambivalent, until I heard yesterday morning on the radio how the case had been decided. I let out an involuntary whoop of joy. I guess now I know what my real opinion was.
