I've heard horror stories about the too-limited scope of the right to repel intruders in England, but I'm not sure that the stories you cited exemplilfy that. They certainly do not stand for the proposition that a property owner cannot use barbed wire nor that he is generally liable for injuries that an intruder suffers from such barriers. Granted, the stories do seem to indicate that property owners in England have to fend off a dispiriting number of squishy "reasonable" qualifiers to win the right to use barbed wire. Even so, that is a long way from saying they cannot lock bums out of their living rooms.Tom W. Nobody wants to live in a world where bums can camp in your living room until you win a court order evicting them."

Actually, I think this accurately describes the current state of British law. Not only are British citizens prohibited from forcefully removing unwanted trespassers by brandishing a firearm or a knife, they are also prohibited from putting barbed-wire on their fences in most circumstances. Even in cases where property owners get special permission to use barbed- wire, owners can still be held liable if a burglar or other trespasser injures himself while illegally entering the property.

See: http://www.ananova.com/news/story/sm_594544.html?menu=
and http://www.mfll.co.uk/you_and_the_law.htm

- Micha Ghertner
Catallarchy.netAnonymousnoreply@blogger.com
